LUNINETS DISTRICT COURT HEARING ON REINSTATEMENT OF OLEG STAKHAEVICH - LEADER OF INDEPENDENT UNION AT RUPP “GRANITE” COMPANY
On April 4 the Luninets district court considered the case on reinstatement of illegally dismissed leader of independent union at RUPP "Granite" Oleg Stakhaevich. The interests of Oleg Stakhaevich in court were represented by BKDP lawyer Elena Eskova and his fellow unionist Anatoly Litvinko. At least 40 people have come to support Oleg Stakhaevich including the BKDP leader Alexander Yaroshuk, his deputy Sergei Antusevich, members of the Independent Miners’ Union (NPG), Belarusian Independent Union (BNP), Free Metalworkers’ Union (SPM) as well as representatives of independent journalists.
Oleg Stakhaevich was sure that it was quite a winning case but at the same time he stressed that the lawyer from RUPP "Granite" Company Sergei Lakhov and the judge were biased by the regime.
Vasili Belsky, the Chairman of Luninets Court, failed to satisfy the written petition of the BKDP lawyer Elena Eskova to submit staff schedule at RUPP "Granite" Company, which could serve as a proof that not all vacancies were offered to Oleg Stakhaevich at the moment of his dismissal.
We recall that the chairman of the BNP primary organization at RUPP "Granite" Company Oleg Stakhaevich was dismissed on February 16, 2012. The employer ignored the application of the union activist for his transfer to another position: assistant to drilling rig machinist of the six grade professional category requiring prior retraining (in such a situation retraining is the responsibility of employer). He did not inform the unionist in due time on the order of his dismissal, he ignored the terms of service-book delivery when dismissing a person, he did not notify the governing body of the BNP union on the upcoming dismissal of chairman of the of the primary organization. https://bkdp.org/home/1/&p=news&newsid=130.
"Both sides presented their arguments on the case, but the defendant's arguments were not convincing. The representative of RUPP "Granit" Company showed his incompetence in issues relating to creation and functioning of trade unions in Belarus. He failed to present a single argument in support of the impossibility of transferring Oleg Stakhaevich to the position of an assistant to drilling rig machinist with prior retraining. However, it is difficult to predict the outcome of the case as there is very little confidence in our judicial system, as concrete practice shows, - said Elena Eskova.
The next court hearing is scheduled on April 11.
