FREE TRADE UNION HAS REINSTATED LEONID GAISHUN AT HIS WORKPLACE

April 30 of the current year Leonid Gaishun – a highly skilled worker who had worked at the company for a total of 36 years – has been dismissed upon expiry of the contract despite the disagreement of the union. The employer has ignored the rule of the plant collective agreement in force which obliges the employer to renew contracts with highly qualified employees.

Leonid Gaishun had the courage to voice his criticisms in relation to the shop master. In addition, on the eve of his dismissal he was able to prove in court that the disciplinary sanction in the form of a reprimand and depriving him of bonus payment which has been imposed on him by the employer illegally. The leader of the SPB and of the primary organization of SPB at Bobruisk company Michael Kavalkov was convinced that the dismissal of Leonid Gaishun is explained by his affiliation to free trade unions and his resolute position in defending the rights of workers. Therefore, the union has immediately prepared an appeal to the court for reinstating him at work.

June 30, 2010 the Court of Bobruisk district and of the town of Bobruisk has taken a decision to reinstate Leonid Gaishun at his wormer workplace. The court also had ordered the employer of the company to recover 3,490,520 Belarusian rubles in his favor as compensation for the time of his enforced idleness.

The employer of Bobruisk Company producing tractor parts and components did not agree with the decision of the court and filed an appeal to higher court authority. On August 16 the Mogilev Regional Court has left the decision of the Court of Bobruisk district and of the town of Bobruisk dated June 30, 2010 in force without changes and the appeal the employer has been rejected without further consideration.
